Summary
Positec Commercial, Inc. (the “Company”) provides Kress Dealers with products
such as parts and accessories on a non-consignment basis giving Kress Dealers
the opportunity to purchase repair parts and accessories for resale to their
customers. The Company passes ownership of non-Consignment products upon
final payment of goods.
Policy
1. The non-consignment products shall be shipped to Dealer Location and
invoiced for payment upon shipment.
2. From the time Dealer receives possession of non-consignment products,
Dealer shall be responsible for paying all expenses related to its possession,
including storage, insuring, selling, and delivery to the end-user.
3. The Dealer shall be responsible for collecting all relevant taxes (including
sales tax) arising from the sale of non-consignment products to the end-user
and for remitting such amounts to the appropriate governmental agency.
4. Dealer shall pay all invoices, less Commission, and applicable programs, to
the Company based on the invoice due date.
5. Dealer’s Commission by model is provided by the Company in Company’s
most recent Product Pricing Bulletin (Dealer Sales Bulletin).
Inventory and Stocking
1. New dealers are provided with a recommended initial stocking order
based upon the mix of KPP (Consignment products) identified for the
dealer. The Dealer and the Company will review and confirm an initial
stocking order. This order will need to be submitted via the dealer
portal.
2. New Orders for non-consignment products are completed by the dealer via
the Dealer portal.
3.
Prior to shipping products, the Company must confirm approval from the
Company Finance Department for the shipment to be released. If there are
issues, they are noted in the Dealer Portal to be resolved.
